Terms of service
These Terms of Service ("Terms") govern your use of gaiabite.com (the "Site") and your purchase of products from GAIABITE, operated by [COMPANY LEGAL NAME] ("GAIABITE", "we", "us" or "our"). By using the Site or placing an order, you agree to these Terms and to our Privacy Policy, Shipping Policy, Refund Policy and Subscription Policy. If you don't agree, please don't use the Site. You must be at least 18 years old, or the legal age to form a binding contract where you live, to buy from us.
1. Orders and acceptance; personal use only
Placing an order is an offer to buy. We accept your offer when we send a shipping confirmation. We may decline or cancel any order — for example, because of a pricing or stock error, suspected fraud, or an address we can't ship to — and will refund anything you paid. Products are sold for personal, non-commercial use. Reselling GAIABITE products without our written consent is not permitted.
2. Subscriptions
If you choose Subscribe & Save, you authorize us to create renewal orders and charge your payment method on the schedule you selected (every 2 months or every 4 months) at the subscription price shown at checkout, until you cancel. Subscriptions renew automatically. We email you before each renewal. You can cancel, pause, skip a delivery or change your delivery date at any time from your account or by contacting us; there is no minimum term and no cancellation fee. To avoid a renewal charge, cancel before the renewal is billed; a renewal that has already been created will ship as scheduled. If we change subscription pricing we'll give you at least 30 days' notice by email before it applies to you. Full details are in our Subscription Policy.
3. Prices and payment
Prices are in U.S. dollars and may change at any time; the price charged is the price shown at checkout. Sales tax is added where required by law. If a product is listed at an incorrect price because of an error, we may cancel the order and refund you in full. Payment is processed at the time of purchase (or at each renewal for subscriptions) using the payment method you provide, which you represent you're authorized to use. Promotional codes and offers can't be combined unless we say otherwise and may be withdrawn at any time.
4. Shipping; title and risk of loss
We ship within the United States as described in our Shipping Policy. Shipping and delivery dates are estimates only and cannot be guaranteed. Title and risk of loss pass to you when we hand the package to the carrier; however, if a package is lost in transit or arrives damaged, we'll replace it or refund you as set out in our Shipping Policy.
5. Returns and refunds
Your first order is covered by our 30-Day Money-Back Guarantee, described in our Refund Policy: contact us within 30 days of delivery and we'll refund the purchase price. In the ordinary case no return is required, though we reserve the right to request a photo or the return of the product before issuing a refund. The guarantee is limited to one per customer or household and doesn't apply to subsequent orders or subscription renewals, which can be cancelled before they're billed. Damaged, leaking or incorrect items are replaced or refunded as described in our Refund Policy.
6. Product information
We try to keep product descriptions, ingredient panels and images accurate, but we don't warrant that content on the Site is complete, current or error-free. Colors and packaging may vary slightly from what's shown. We may change or discontinue products, prices and promotions at any time without notice.
7. Animal-use and health disclaimer
GAIABITE Fish Oil for Pets is a nutritional supplement for dogs and cats only. It is for animal use only and not for human consumption. It is not intended to diagnose, treat, cure or prevent any disease, and nothing on the Site is veterinary advice. Consult your veterinarian before use if your pet is pregnant, nursing, has a medical condition or is taking medication; stop use and consult your veterinarian if any adverse reaction occurs. Always follow the serving directions on the label for your pet's body weight, and keep the product out of reach of children. Individual results vary.
8. Intellectual property
The Site and everything on it — including the GAIABITE name and logo, text, images, packaging designs and layout — are owned by or licensed to us and protected by trademark, copyright and other laws. You may not copy, reproduce, distribute or create derivative works from any part of the Site, or use our trademarks, without our prior written consent.
9. Reviews and content you submit
If you submit a review, photo or other content, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce and display it in connection with our products and marketing, and you confirm it is your own, honest and not misleading. We may remove any submitted content at our discretion.
10. Privacy
Our Privacy Policy explains how we collect, use and share your information when you use the Site or place an order, and is incorporated into these Terms.
11. Communications
You agree that the contact information you give us is accurate and that you'll keep it up to date. By providing your email address or phone number you agree to receive transactional messages about your orders and subscriptions (order confirmations, shipping updates, renewal reminders). Marketing emails or texts are sent only with your consent, and you can unsubscribe at any time using the link in any email or by replying STOP to a text.
12. Disclaimer of warranties
Except as expressly stated in these Terms and our Refund Policy, the Site and our products are provided "as is" and "as available", and we disclaim all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We don't warrant that any particular result will be achieved from using our products, or that the Site will be uninterrupted or error-free. Some states don't allow the exclusion of implied warranties, so some of these exclusions may not apply to you.
13. Limitation of liability
To the fullest extent permitted by law, GAIABITE and its owners, officers, employees, suppliers and agents won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or data, arising out of or related to the Site, our products or these Terms. Our total liability for any claim will not exceed the amount you paid us in the six (6) months before the claim arose. Some states don't allow these limitations, so some may not apply to you.
14. Indemnification
You agree to indemnify and hold GAIABITE harmless from any claims, losses and expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your misuse of the Site or our products, or your violation of any law or third-party rights.
15. Force majeure
We aren't responsible for delays or failures caused by events beyond our reasonable control, including carrier disruptions, weather, natural disasters, labor disputes, supplier or manufacturing interruptions, pandemics or government action. We'll do our best to keep you informed and to fulfil your order as soon as we can.
16. Governing law and disputes
These Terms are governed by the laws of the State of [STATE], without regard to its conflict-of-law rules. If you have a problem, please contact us first — most issues can be resolved quickly and informally. Any dispute that can't be resolved informally within 30 days will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may bring an individual claim in small-claims court. YOU AND GAIABITE EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION OR CONSOLIDATED PROCEEDING. You may opt out of this arbitration provision by emailing us within 30 days of your first purchase.
17. General
We may update these Terms from time to time; the version posted on the Site at the time of your order applies to that order. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision isn't a waiver of it. These Terms, together with the policies referenced above, are the entire agreement between you and GAIABITE regarding the Site and your purchases. You may not assign these Terms without our consent.
