Terms of Service

These Terms of Service ("Terms") govern your use of gaiabite.com (the "Site") and your purchase of products from GAIABITE, operated by [COMPANY LEGAL NAME] ("GAIABITE", "we", "us" or "our"). By using the Site or placing an order, you agree to these Terms, our Privacy Policy, Shipping Policy, Refund Policy and, if you subscribe, our Subscription Policy. If you don't agree, please don't use the Site. You must be at least 18 years old and able to enter into a binding contract to buy from us.

1. Orders and acceptance; personal use only

Placing an order is an offer to buy. We accept your offer when we send a shipping confirmation, and we may decline or cancel any order — for example, because of a pricing or stock error, suspected fraud, or an address we can't ship to — in which case we'll refund anything you paid. Products are sold for personal, non-commercial use. Reselling GAIABITE products without our written consent is not permitted.

2. Subscriptions

If you choose Subscribe & Save, you authorize us to create renewal orders and charge your payment method on the schedule you selected (every 2 months or every 4 months) at the subscription price shown at checkout, until you cancel. We email you before each renewal. You can cancel, pause, skip a delivery or change your delivery date at any time from your account or by contacting us; there is no minimum term and no cancellation fee. Changes apply to renewals that haven't been billed yet. If we change subscription pricing we'll give you at least 30 days' notice by email before it applies to you. 3. Prices and payment

Prices are in U.S. dollars and may change at any time; the price charged is the price shown at checkout. Sales tax is added where required by law. If a product is listed at an incorrect price because of an error, we may cancel the order and refund you in full. Payment is processed at the time of purchase (or at each renewal for subscriptions) using the payment method you provide, which you represent you're authorized to use.

4. Shipping; title and risk of loss

We ship within the United States as described in our Shipping Policy. Delivery times are estimates, not guarantees. Title and risk of loss pass to you when we hand the package to the carrier; however, if a package is lost in transit or arrives damaged, we'll replace it or refund you as set out in our Shipping Policy.

5. Refunds and the money-back guarantee

Your first order is covered by our 30-Day Money-Back Guarantee, described in our Refund Policy: contact us within 30 days of delivery and we'll refund the purchase price without requiring a return. The guarantee is limited to one per customer or household and doesn't apply to subsequent orders or subscription renewals, which can be cancelled before they're billed. Damaged, leaking or incorrect items are replaced or refunded as described in our Refund Policy.

6. Product information; not veterinary advice

GAIABITE Fish Oil for Pets is a nutritional supplement intended for dogs and cats only. It is not intended for human consumption and is not intended to diagnose, treat, cure or prevent any disease. Information on the Site is provided for general educational purposes and is not veterinary advice. Consult your veterinarian before use if your pet is pregnant, nursing, has a medical condition, or is taking medication, and stop use and consult your veterinarian if any adverse reaction occurs. Always follow the serving directions on the label for your pet's body weight. We try to keep product descriptions accurate, but we don't warrant that descriptions, images or other content on the Site are complete, current or error-free, and we may change or discontinue products at any time.

7. Intellectual property

The Site and everything on it — including the GAIABITE name and logo, text, images, packaging designs and layout — are owned by or licensed to us and protected by trademark, copyright and other laws. You may not copy, reproduce, distribute or create derivative works from any part of the Site, or use our trademarks, without our prior written consent.

8. Reviews and content you submit

If you submit a review, photo or other content, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce and display it in connection with our products and marketing, and you confirm it is your own, honest and not misleading. We may remove any submitted content at our discretion.

9. Disclaimer of warranties

Except as expressly stated in these Terms and our Refund Policy, the Site and our products are provided "as is" and "as available", and we disclaim all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We don't warrant that any particular result will be achieved from using our products, or that the Site will be uninterrupted or error-free. Some states don't allow the exclusion of implied warranties, so some of these exclusions may not apply to you.

10. Limitation of liability

To the fullest extent permitted by law, GAIABITE and its owners, officers, employees, suppliers and agents won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or data, arising out of or related to the Site, our products or these Terms. Our total liability for any claim will not exceed the amount you paid us for the product(s) giving rise to the claim in the six months before the claim arose. Some states don't allow these limitations, so some may not apply to you.

11. Indemnification

You agree to indemnify and hold GAIABITE harmless from any claims, losses and expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your misuse of the Site or our products, or your violation of any law or third-party rights.

12. Communications

By providing your email address or phone number you agree to receive transactional messages about your orders and subscriptions (for example, order confirmations, shipping updates and renewal reminders). Marketing emails or texts are sent only with your consent, and you can unsubscribe at any time using the link in any email or by replying STOP to a text.

13. Governing law and disputes

These Terms are governed by the laws of the State of [STATE], without regard to its conflict-of-law rules. If you have a problem, please contact us first — most issues can be resolved quickly and informally. Any dispute that can't be resolved informally within 30 days will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may bring an individual claim in small-claims court. You and GAIABITE each waive the right to a jury trial and to participate in a class action. You may opt out of this arbitration provision by emailing us within 30 days of your first purchase.

14. General

We may update these Terms from time to time; the version posted on the Site at the time of your order applies to that order. If any provision of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision isn't a waiver of it. These Terms, together with the policies referenced above, are the entire agreement between you and GAIABITE regarding the Site and your purchases. You may not assign these Terms without our consent.
